This website is operated and owned by JV Pharma Limited. Throughout the site, the terms “we”, “us” and “our’ refer to JV Pharma Limited (also referred to as “JV Pharma” or “JVP”). JVP offers this website, including all information, tools and services available from this site to you, the user, on condition that there is acceptance of all terms, conditions, policies and notices stated within this website.
Clause 1 – Availability and Accuracy
Products displayed on our website may not be in stock as will be displayed on the website. For inquiries of certain product availabilities, please send an email to support@healthneeds.com.mt .

The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Clause 2 – Pricing
All prices displayed on the website are indicated in Euro and are inclusive of applicable Malta VAT rates. Delivery charges (where applicable) are not included in the indicated price but will be added to the total amount once you have selected a delivery option. Orders over €40 will not be subject to delivery charges.
Clause 3 – Deliveries
We deliver orders to anywhere in Malta and Gozo.
Delivery is free for all orders over €40.00 in Malta and Gozo – a €5.00 delivery charge applies for orders below €40.00.
Orders will be delivered within 2-3 working days. Delivery times are based on orders placed between Monday – Friday (excluding public holidays). The service provider does not operate on weekends.
The Courier service is carried out by Connect Express Couriers. The service provider may attempt to call the user to expedite the delivery process and avoid failed delivery attempts.
Clause 4 – Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
Clause 5 – General Conditions
We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
JVP may assign, transfer or sub-contract any rights or obligations under these Terms and Conditions to any third party. The Customer, however, is not entitled to assign, transfer or sub-contract any rights or obligations under these Terms and Conditions without the express written consent JVP.
JVP reserves the right to amend these Terms and Conditions from time to time. Provided that such amendment shall be (a) published on its website and (b) such amendments shall not be more prejudicial to the rights of the Customer. No other variation or amendment to these Terms and Conditions shall bind either Party unless agreed to in writing by duly authorised by both Parties.
The headings in these Terms and Conditions are for convenience only and shall not have any legal or interpretative effect.
These Terms and Conditions govern the entire relationship between the Parties and will remain in force for the duration of the trading relationship in relation to the Goods. All previous agreements, undertakings, commitments, undertakings or representations on the part of the Parties are hereby superseded. No intellectual property rights in connection with the Goods shall devolve upon the Customer. JVP, or the manufacturer as the case may be, shall be the sole owners and/or licensors of such intellectual property, including any trademarks, patents or other similar rights.
You, the Customer in purchasing the Goods or in requesting JVP to carry out Services are expressly confirming that you have fully read and understood these Terms and Conditions and are aware of the contents thereof, including your obligations and the warranties and limitations on liability set out herein.
Clause 6 – Modifications to the Service and Prices
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Clause 7 – Payments
Payments are strictly to be settled through online payment only. No cash payments will be accepted.
Clause 8 – Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Clause 11 – Data Protection
On purchasing the product/s or in requesting that a Service is carried out, the Customer agrees and consents that JVP and Connect Express Couriers may store, process and use personal information and other data collected on the Customer for any communication purpose with the Customer relating to the Goods or Services, for any matter related to these Terms and Conditions (for example the data storage of warranty periods).
Furthermore, the Customer also hereby agrees and consents to JVP sharing personal information and other data collected with other companies in the group to which JVP forms part in compliance with applicable Data Protection legislation. Should the Customer wish to have access to the information and data held, to effect any changes to such data, or to cease to receive any marketing or promotional material from JVP or any other company in the group, the Customer is requested to inform JVP by email on support@healthneeds.com.mt .
Moreover, the Customer also hereby agrees and consents that for the better carrying out of services by JVP as well as for training purposes and/or in order to improve the quality of customer services, JVP may monitor and/or record communications, including any telephone calls made to or by JVP.
Clause 12 – Errors, Inaccuracies and Omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Clause 15 – Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Any disputes arising in relation to any purchases made on this Website, or which are otherwise related to this Website or the Services or Products being offered on the Website, will be subject to the exclusive jurisdiction of the Courts of Malta.
The above does not affect your statutory rights, in terms of Chapter 378 of Section 78 of the Consumer Affairs Act.
